Given the international competition today, the objective of regulatory systems on the Islands is to encourage a culture of compliance so as to contribute to the reputational image of the offshore jurisdictions as both attractive and safe places to do business.

This will usually be achieved through a joined-up framework that includes the following elements:

  • Setting up, adhering to, and updating existing policies and procedures to ensure compliance with regulatory obligations
  • Ensuring compliance with Anti-Money Laundering (AML) and Counter-Terrorism Financing (CTF) initiatives to combat crime
  • Identifying common best practices to raise the level of compliance in the offshore financial services industry
  • Ensuring effective corporate governance frameworks are in place that are appropriate to entities’ size, complexity, structure and risk profile
  • Facilitation exchanges between the senior management of financial services institutions organisations and regulators and law enforcement agencies

Beyond the compliance and risk control functions in place within individual companies, the Islands also have professional bodies that serve the following additional objectives:

  • Providing members with the information to assist with the implementation and ongoing maintenance of effective compliance and AML/CTF programmes
  • Advice on building a strong and effective corporate governance policy to support the business and Board of Directors
  • Facilitating open forums for sharing information, training, and discussing new legislation or required best practice
